General Terms and Conditions with Customer Information

1) Scope

1.1 These General Terms and Conditions (hereinafter referred to as the “GTC”) apply to all contracts for the purchase and delivery of goods concluded between Homejoy (hereinafter referred to as the “Seller”) and a consumer or business customer (hereinafter referred to as the “Customer”) through the Seller’s online shop. Any terms and conditions provided by the Customer shall not apply unless expressly agreed otherwise.


1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity. A business or entrepreneur within the meaning of these GTC is a natural or legal person, or a partnership with legal capacity, acting in the course of their commercial or self-employed professional activity when entering into a legal transaction.


2) Conclusion of the Contract

2.1 The product descriptions displayed in the Homejoy online shop do not constitute legally binding offers by the Seller. They are intended to enable the Customer to submit a binding offer to purchase the respective products.


2.2 The Customer may submit an offer using the online order form available in the Seller’s online shop. After placing the selected products in the virtual shopping basket and completing the electronic checkout process, the Customer submits a legally binding offer to purchase the products contained in the shopping basket by clicking the button that completes the ordering process.


2.3 The Seller may accept the Customer’s offer within five days:

- by sending the Customer a written order confirmation or an order confirmation in text form, particularly by email, in which case the date on which the order confirmation is received by the Customer shall be decisive;

- by dispatching or delivering the ordered goods to the Customer, in which case the date on which the goods are received by the Customer shall be decisive; or

- by requesting payment from the Customer following the order.

If more than one of the above alternatives applies, the contract shall be concluded at the time when the first of these alternatives occurs. The period for accepting the offer begins on the day after the Customer submits the offer and ends at the end of the fifth day following submission of the offer. If the Seller does not accept the Customer’s offer within this period, the offer shall be deemed rejected and the Customer shall no longer be bound by their declaration of intent.


2.4 If the Customer selects a payment method provided by PayPal, payment will be processed through PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), subject to the applicable PayPal terms and conditions.

If the Customer uses a PayPal payment method offered during the online checkout process, the Seller may accept the Customer’s offer at the time the Customer clicks the button completing the ordering process.


2.5 Where an order is submitted through the Seller’s online order form, the contractual information is stored by the Seller after conclusion of the contract and provided to the Customer in text form, for example by email, after the order has been submitted.

If the Customer has created a user account in the Homejoy online shop before placing the order, the relevant order information may also be stored within the Customer’s account and can be accessed using the corresponding login details.


2.6 Before submitting a binding order through the Seller’s online order form, the Customer can review the information entered and identify possible input errors by carefully checking the information displayed during checkout.

The Customer can correct their entries using the standard keyboard, mouse or touchscreen functions available on their device until the button completing the ordering process is clicked.


2.7 The contract may be concluded in the English language.


2.8 Order processing and communication generally take place electronically, particularly via email and automated order processing systems. The Customer is responsible for ensuring that the email address provided when placing the order is correct and capable of receiving emails sent by the Seller.

When using spam filters or similar systems, the Customer should ensure that emails sent by Homejoy or third parties commissioned by Homejoy to process the order can be received.


3) Right of Withdrawal

3.1 Consumers generally have a statutory right of withdrawal where applicable.

4) Prices and Payment Terms

4.1 Unless otherwise stated in the relevant product description, the prices displayed in the Homejoy online shop are the final prices payable for the products. Where applicable, taxes are included in accordance with the relevant legal requirements. Any additional delivery, shipping or other charges will be displayed separately before the Customer completes the order.


4.2 The payment methods currently available to the Customer are displayed during the checkout process in the Homejoy online shop.


4.3 Where a payment method provided by a third-party payment service provider is selected, payment processing will be carried out by the respective payment service provider in accordance with its applicable terms and conditions.

The Customer may be required to provide additional information, authenticate themselves or confirm the payment instruction as part of the payment process.
